The New York State Senate passed Assembly Bill 6811C, the Lithium-Ion Battery Safety Program, by a vote of 43-18, with the measure taking effect immediately. The bill authorizes NYSERDA to replace lithium-ion batteries for free and provide rebates for electric bike purchases. However, the legislation drew criticism from Sen. Borrello, who warned of an unintended loophole that could be exploited by individuals purchasing used electric bikes, obtaining free battery replacements and rebates, and reselling them at taxpayer expense. Borrello argued the bill contains no spending limits and could result in thousands of units being distributed without fiscal controls, creating what he characterized as a potential cottage industry. Eighteen senators voted against the measure, including Ashby, Borrello, Canzoneri-Fitzpatrick, Gallivan, Griffo, Helming, Lanza, Martins, Mattera, Murray, Oberacker, O'Mara, Ortt, Rhoads, Stec, Tedisco, Weber, and Weik.
