The New York State Senate passed Sen. Bottcher's first bill, legislation requiring New York City marshals to electronically serve notices of eviction within one business day of service. The measure passed 44-16 on a roll call vote. Bottcher, speaking in explanation of his vote, said the bill addresses a gap in implementation of prior law by ensuring tenants receive timely and accurate information about eviction proceedings. "This bill simply clarifies the law by requiring marshals to physically post electronically filed notices of eviction within one business day of service," Bottcher said, adding that the measure ensures tenants have time to seek legal assistance, apply for rental aid, or pursue relief before an eviction occurs. Bottcher characterized the legislation as promoting transparency and meaningful due process protections at a time when housing instability continues to affect many New Yorkers. The bill amends the Real Property Actions and Proceedings Law. Sixteen senators, all Republicans, voted against the measure.
