The New York State Senate passed S4867, legislation sponsored by Sen. Fahy to prohibit insurers from imposing first-fail step therapy or prior authorization requirements on medications used to treat serious mental health conditions. The bill passed on a 60-1 roll call vote, with only Sen. Walczyk voting in opposition. Sen. Fahy argued that current insurance practices force patients with schizophrenia, bipolar disorder, severe depression, PTSD, and substance use disorders to fail on inappropriate medications before accessing doctor-recommended treatments, causing psychiatric deterioration and increasing costs through emergency room visits and hospitalizations. She emphasized that mental health treatment is highly individualized and that insurance company barriers can destabilize patients when rapid medication adjustments are necessary. The legislation takes effect January 1.
