The New York State Senate passed S8077, an act to amend Part B of Chapter 56 of the Laws of 2020, by a vote of 59-0 on June 12. The bill's passage came after the chamber rejected a proposed amendment that would have allowed home-schooled students to participate in school athletic activities. Sen. Oberacker, who sponsored the amendment, argued that current policy discriminates against home-schoolers by barring them from sports while permitting them to join other extracurricular activities such as chess clubs, school plays, and math teams. Oberacker noted that home-schooled students already meet the same vaccination requirements as public school students and currently play alongside public school peers on travel teams. Acting President Bailey ruled the amendment nongermane under Senate Rule 6, Section 4B, citing that it fell outside the scope of the underlying bill. An appeal of the ruling failed on a show of hands vote, 21-0, sustaining the chair's decision. The underlying bill then advanced to a full roll call vote and passed unanimously.
